These Terms of Service ("Terms") govern your access to and use of this website, its landing pages, and any forms or booking tools made available on it (collectively, the "Services"), operated by Ian McDonald doing business as RIG Automations ("RIG Automations," "we," "us," or "our").
PatioPilot is a product of RIG Automations. References to PatioPilot on our marketing websites, forms, and booking pages identify that product; the operator of these Services remains Ian McDonald doing business as RIG Automations.
By accessing or using the Services, including by submitting a form or booking a call, you agree to be bound by these Terms. If you do not agree, do not use the Services.
1.Who Can Use the Services
You must be at least 18 years old and able to form a legally binding contract to use the Services. If you are using the Services on behalf of a business, you represent that you have the authority to bind that business to these Terms.
2.Description of Services
The Services provide information about RIG Automations’ products and services, including PatioPilot, and allow visitors to request information, submit an inquiry, or book an introductory call. The Services are informational and promotional in nature. Nothing on this website constitutes a binding offer to provide paid services. Any paid engagement, software subscription, or access to PatioPilot will be governed by the separate written agreement applicable to that engagement or product, which will control over these Terms for that engagement or product.
3.Booking a Call
Call bookings are scheduled through a third-party scheduling tool (such as HighLevel and connected calendar providers). By booking a call, you agree to:
- Provide accurate contact information
- Attend the scheduled call or reschedule/cancel with reasonable notice
- Be contacted by phone, text (SMS), and/or email regarding your booking, as described in our Privacy Policy
We reserve the right to reschedule or cancel a booked call at our discretion, and to decline to schedule or continue a call with anyone for any lawful reason.
4.No Guarantee of Results
Any examples, illustrations, testimonials, case studies, or descriptions of past results referenced on this website or during a call are provided for informational purposes only and do not guarantee that you will achieve similar results. Outcomes from automation or systems-building work depend on factors specific to your business, including your existing tools, processes, team, and market conditions. Nothing on this website or communicated during a call should be construed as a guarantee, warranty, or promise of specific results, revenue, savings, or performance.
5.Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose or in violation of these Terms
- Submit false, misleading, or fraudulent information through any form
- Attempt to interfere with, disrupt, or gain unauthorized access to the Services, our systems, or data
- Scrape, copy, or reproduce the content of this website for commercial purposes without our written permission
- Use the Services to transmit spam, malware, or harmful code
6.Intellectual Property
All content on this website, including text, graphics, logos, illustrations, animations, and design, is owned by RIG Automations or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may view and share pages of this website for personal, non-commercial reference. You may not copy, modify, distribute, or create derivative works from this content for commercial purposes without our prior written consent.
7.Third-Party Services and Links
The Services may link to or incorporate third-party tools (such as HighLevel and connected calendar providers for scheduling, or a separately hosted client tool). We do not control and are not responsible for the content, privacy practices, availability, or terms of those third-party services. Your use of any third-party service is governed by that provider's own terms and policies.
8.Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY INFORMATION ON THE SERVICES IS ACCURATE OR COMPLETE.
9.Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, RIG AUTOMATIONS AND IAN MCDONALD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES DESCRIBED IN THESE TERMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100).
This limitation does not apply to liability that cannot be limited or excluded under applicable law, and does not affect the terms of any separate signed services agreement, which will govern liability for paid engagements.
10.Indemnification
You agree to indemnify and hold harmless RIG Automations and Ian McDonald from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Services.
11.Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Services shall be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
12.Changes to These Terms
We may update these Terms from time to time. The "Effective Date" above reflects the most recent revision. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
13.Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
14.Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and RIG Automations regarding use of the Services and supersede any prior agreements regarding the Services, except as otherwise provided in a separate signed services agreement.
